This paper suggests a way to elaborate the ethical implications of the Warsaw International Mechanism (WIM) as decided at COP 19 from the perspective of justice. It advocates three pro-posals. First, in order to fully understand the responsibilities and liabilities implied in the WIM, adaptation needs to be distinguished from loss and damage (L&D) on the basis of the different goals which should be attributed to adaptation and to L&D approaches. Second, the primary concern of the WIM should be compensatory (...) justice. In case of climate L&D, three aspects of compensatory justice should be kept separate: corrective liability, remedial responsibility, and with regard to the resources available, fair remedy. Third, it is crucial to distinguish between recov-erable damage and irrecoverable or at least not fully recoverable loss. This distinction is crucial because it informs the principles of fair remedy and because damage and loss may differ in their relevance for the stability and functioning of a human system. (shrink)

This paper argues that an analysis of the dissatisfactory outcomes of international negotiations concerning climate change must take into account procedures of political decision‐making in democracies. Although the normative ideal of republican democracy has means of dealing with such dissatisfactory results, political processes in republican democracies take too much time and risk becoming stuck in tragic or dilemmatic decision structures when facing challenges such as climate change. Consequently, this paper discusses possibilities for redesigning republican democratic institutions to counter‐act these negative (...) forces. The Paris Climate Agreement is an important step for international climate policy, but the compensation for negative effects of climate change based on clear assignment of responsibilities remains highly debated. From both a policy and a science perspective, it is unclear how responsibilities should be defined and on what evidence base. We explore different normative principles of justice relevant to climate change impacts, and ask how different forms of causal evidence of impacts drawn from detection and attribution research could inform (...) policy approaches in accordance with justice considerations. We reveal a procedural injustice based on the imbalance of observations and knowledge of impacts between developed and developing countries. This type of injustice needs to be considered in policy negotiations and decisions, and efforts strengthened to reduce it. (shrink)

In this paper I argue for the following conclusions. First, quotas are not normative goals in themselves but only a means to reach non-discriminatory selection procedures. Second, in a democracy quotas are most plausibly used as a means to fill offices in those bodies which have a major impact on how well interests or discourses are translated into policy. Third, quotas for the young can be justified since, due to demographic development, their discourses tend to be marginalized. Fourth, youth quotas (...) cannot be a means to ensure long-term policy-making, but they can enhance legitimacy of long-term impacts from policy decisions taken today. (shrink)

Although I believe that Gardiner and Fragnière are right to claim that geoengineering governance demands participatory structures, I think more caution is needed. First, the public to be considered because it is affected must be differentiated depending on the geoengineering technique at issue and on the severity of its impact. Second, to avoid undermining democratic legitimacy, ethical conditions of legitimacy must be carefully assessed. Even though future generations and nature are very likely to be affected by geoengineering, their representation is (...) not as unproblematic as it might seem at first sight. (shrink)

Ethics in managing climate change most often involves two issues that are tightly connected. The first involves considerations about the just distribution of entitlements and burdens, and the second concerns the fair differentiation of responsibilities. The chapter explains the most important ethical implications of international climate politics and shows why justice plays a key role in all areas of climate policy. Furthermore, it introduces the main domains of climate justice: historical, global, and intergenerational justice. Depending on the policy area at (...) issue, different combinations of principles of climate justice seem most appropriate. The chapter concludes by showing that the differentiation of responsibilities depends not only on which principles of justice are employed but also on the particular climate policy area and level that are at issue. In this comment a challenge Kerr’s claim that a coherent expression of a ‘liberalism of freedom’ needs an extended first Rawlsian principle of justice incorporating the principle of fair equality of opportunity for two reasons. First, such an extended first principle leads to illiberal consequences by narrowing down the scope of individual responsibility for choice and effort way too much. Second, such an extended first principle misses a main Rawlsian insight, namely that in a theory of justice the principle securing (...) basic liberties and the principle of fair equality of opportunity serve different purposes. This volume includes essays presented at the conference on Emotions and Rationality in Moral Philosophy held at the Universities of Neuchâtel and Bern in October 2005. The authors of this volume share the Humean insight that the ‘sentiments’ have a crucial role to play in elucidating the practice of morality. In a Humean fashion, they warn us against taking an intellectualist view of emotions and reject the rationalist account of morality.

As our experience with this special issue shows, climate change is such a multi-faceted problem that interdisciplinary research is a necessity. This is much more easily said than done. In the course of the publication of this special issue there were many lessons to be learned. First of all we saw how the exchange between our authors allowed them to expand the focus of their respective disciplines. Philosophers considered literature from various fields they would not have touched upon in their (...) usual course of inquiry. Scientists and legal scholars became more sensitive to the normative dimensions and justice-related intricacies involved in their research. This enabled all contributors to open up to different vocabularies and standards of research. At the same time, however, several obstacles to the success of this issue emerged as well. For such an endeavor it is necessary to find researchers who are ready to engage with other disciplines and to take up ideas and comments which at first sight might not seem relevant and out of place from their disciplinary perspective. Due to the special format another challenge was to communicate the interdisciplinary character of this special issue to the reviewers and to put the reviews in context accordingly without risking to diminish the disciplinary quality of contributions. For the guest editors this came with a further challenge. We not only had to become familiar with different disciplinary vocabularies and standards of research but also had to judge the quality and relevance of contributions in the light of our overall aim as well as disciplinary standards of quality. Attitudes toward repository projects cannot be explained merely on the basis of perceived risks, trust, or technical information. Issues of justice and fairness frequently arise when burdens and benefits are to be allocated. A fair distribution across the various parts of a given territory of the waste to be stored is unlikely to be accomplished as it is contingent on appropriate geological formations and other factors. The process by which the specific distribution is determined and accomplished needs to be taken (...) into account as well. Thus, justice evaluations of both the distributive outcome and the process itself, by which the outcome is accomplished, are likely to affect people’s attitudes toward and acceptance of siting decisions. Data from a number of methodically different studies conducted over the last eight years on site selection in Switzerland suggest that a fair procedure is more essential than a fair distribution to a consensus about the decisions made. As a consequence, even normative assessments of the fairness of a distribution of nuclear waste must consider procedural justice as a valuable indicator, independently of the particular shape of the distribution. However, contextual factors, such as the wider nuclear energy strategy of a country, may compete with procedural fairness in terms of importance. Even though fairness is a requirement it does not guarantee acceptance. It may, however, enhance acceptability from a moral standpoint. (shrink)

The debate on “Loss and Damage” (L&D) has gained traction over the last few years. Supported by growing scientific evidence of anthropogenic climate change amplifying frequency, intensity and duration of climate-related hazards as well as observed increases in climate-related impacts and risks in many regions, the “Warsaw International Mechanism for Loss and Damage” was established in 2013 and further supported through the Paris Agreement in 2015. Despite advances, the debate currently is broad, diffuse and somewhat confusing, while concepts, methods and (...) tools, as well as directions for policy remain vague and often contested. This book, a joint effort of the Loss and Damage Network—a partnership effort by scientists and practitioners from around the globe—provides evidence-based insight into the L&D discourse by highlighting state-of-the-art research conducted across multiple disciplines, by showcasing applications in practice and by providing insight into policy contexts and salient policy options. This introductory chapter summarises key findings of the twenty-two book chapters in terms of five propositions. These propositions, each building on relevant findings linked to forward-looking suggestions for research, policy and practice, reflect the architecture of the book, whose sections proceed from setting the stage to critical issues, followed by a section on methods and tools, to chapters that provide geographic perspectives, and finally to a section that identifies potential policy options. The propositions comprise (1) Risk management can be an effective entry point for aligning perspectives and debates, if framed comprehensively, coupled with climate justice considerations and linked to established risk management and adaptation practice; (2) Attribution science is advancing rapidly and fundamental to informing actions to minimise, avert, and address losses and damages; (3) Climate change research, in addition to identifying physical/hard limits to adaptation, needs to more systematically examine soft limits to adaptation, for which we find some evidence across several geographies globally; (4) Climate risk insurance mechanisms can serve the prevention and cure aspects emphasised in the L&D debate but solidarity and accountability aspects need further attention, for which we find tentative indication in applications around the world; (5) Policy deliberations may need to overcome the perception that L&D constitutes a win-lose negotiation “game” by developing a more inclusive narrative that highlights collective ambition for tackling risks, mutual benefits and the role of transformation. Electronic sports and other variants of ‘digital sports’ have increased in popularity all over the world and may even come to challenge hegemonic concepts of sport. More relevant than the apparent opposition between ‘physical’ and ‘non-physical’ is the question what kind of embodiment is manifested within virtual environments. In this paper, we argue that eSports do require the learning and performance of motor skills and that embodiment within a virtual environment may be considered playful or even athletic. The type of (...) skills that might be tested can even be considered fundamental movement skills. Under appropriate educational supervision, with knowledge of the game, eSports can be utilized for the development of specific elements of digital literacy. Although motor skills are a defining characteristic of eSports, we do not argue that eSports should be integrated within PE. In cooperation with the Philosophical Faculty of Sofia University, the Bulgarian Philosophical Society organized the conference "Phenomenologies: the legacies of Edmund Husserl," which took place on 6 and 7 November 2015, and became the founding event of BFO-Fenomenologia – the Phenomenological Association as a community of the Bulgarian Philosophical Society. The Association offers a new home for Bulgarian scholars and groups from different phenomenological currents.

Após a conclusão do curso de medicina psiquiátrica em Lyon, em 1951, Fanon foi acolhido no hospital Saint Alban, para um aprofundamento dos estudos psiquiátricos, tendo ali, trabalhado e pesquisado sob a supervisão do psiquiatra espanhol Francesc Tosquelles, onde praticou os fundamentos da psicoterapia institucional, desenvolvida por Tosquelles e seus colaboradores naquele hospital. Mais tarde, na Argélia, Fanon atuou no hospital de Blida-Joinvile e, posteriormente, na Tunísia, introduzindo reformas, à luz da psicoterapia institucional. A concepção de ser humano que cultivava (...) e a compreensão de que a sociedade doente produz pessoas doentes, levaram-no a um profundo conflito, à medida em que foi tomando consciência da violência do colonialismo francês contra o povo argelino, conforme relatou na carta de demissão que enviou ao Ministro Residente, Robert Lacoste, em 1956. Após o pedido de demissão, adentrou o movimento de libertação da Argélia. Escreveu livros e artigos combatendo o colonialismo e difundindo os ideais revolucionários. Van Renssalaer Potter, por longo tempo atuou como biólogo e bioquímico no MacArdle Laboratory for Cancer Research, na Universidade de Winsconsin, na cidade de Madison, onde doentes de câncer eram tratados. Na década de 1970, publicou um livro seminal, Bioética, ponte para o futuro. Anos depois, publicou estudos de Bioética Global. Mais tarde, articulou conceitos de Bioética Profunda. Preocupado com a sobrevivência humana neste planeta, atacado pela irresponsabilidade humana, Potter conclamou a humanidade à tomada de consciência e mudança de condutas. Comparando-se os dois autores, observa-se que os escritos de Fanon foram produzidos na década de 1950, sendo que seu último livro, Os Condenados da Terra, foi escrito em 1961. Potter, por sua vez, escreveu os primeiros estudos de bioética na década de 1970, cerca de uma década após o falecimento de Fanon. Respeitados os limites cronológicos, este estudo se pergunta: A dialética da medicina como política e da política como medicina, na práxis de Fanon, teria sintonias bioéticas? Para enfrentar este problema, o trabalho contextualiza a formação de Fanon, identificando os princípios da práxis médico-psiquiátrica dele. Em seguida, demonstra-se as contradições do colonialismo, identificando uma dialética da medicina como política e da política como medicina. Adiante, informa-se a contribuição de Van Rensselaer Potter, na proposição da bioética. Finalmente, argumenta-se a favor das sintonias bioéticas presentes nas passagens selecionadas. In Transparent Intensional Logic we can recognize two distinct notions of computation that loosely correspond to term rewriting and term interpretation as known from lambda calculus. Our goal will be to further explore these two notions and examine some of their properties.

In die Geschichte sind Franz Josef Graf von Thun (1734-1801) und seine Frau Wilhelmine (1744-1800) als Gonner des Geniemusikers Wolfgang Amadeus Mozart eingegangen. Der "sonderbare Cavalier", wie er von Mozart genannt wurde, war seinen Zeitgenossen eher als Geisterbeschworer und Magnetiseur, denn als Musikliebhaber und Schriftsteller bekannt. Erst 2009 tauchte im Familienarchiv Thun-Hohenstein das Manuskript der umfangreichen esoterischen Enzyklopadie auf, in der Graf von Thun seine Ansichten uber den Menschen, uber das Weltall und uber die Franzosische Revolution darlegt. Ivo Cerman stellt (...) hier die Philosophie des Grafen vor dem Hintergrund des Illuminismus des 18. Jahrhunderts vor und ediert die wichtigsten Artikel seiner esoterischen Enzyklopadie. Auf der Grundlage dieser gerade entdeckten wichtigen Quelle kann die Frage nach dem Verhaltnis zwischen Aufklarung und Illuminismus neu beantwortet werden. (shrink)

In this paper we examine two approaches to the formal treatment of the notion of problem in the paradigm of algorithmic semantics. Namely, we will explore an approach based on Martin-Löf’s Constructive Type Theory, which can be seen as a direct continuation of Kolmogorov’s original calculus of problems, and an approach utilizing Tichý’s Transparent Intensional Logic, which can be viewed as a non-constructive attempt of interpreting Kolmogorov’s logic of problems. In the last section we propose Kolmogorov and CTT-inspired modifications to (...) TIL-based approach. The focus will be on non-empirical problems only. (shrink)

Proofs from assumptions are amongst the most fundamental reasoning techniques. Yet the precise nature of assumptions is still an open topic. One of the most prominent conceptions is the placeholder view of assumptions generally associated with natural deduction for intuitionistic propositional logic. It views assumptions essentially as holes in proofs, either to be filled with closed proofs of the corresponding propositions via substitution or withdrawn as a side effect of some rule, thus in effect making them an auxiliary notion subservient (...) to proper propositions. The Curry–Howard correspondence is typically viewed as a formal counterpart of this conception. I will argue against this position and show that even though the Curry–Howard correspondence typically accommodates the placeholder view of assumptions, it is rather a matter of choice, not a necessity, and that another more assumption-friendly view can be adopted. The article discusses the reception of Grotius by Catholic lawyers at the university of Prague. It focuses on the Grotius commentary by Nicolaus Ignaz Königsmann, which was meant as a response to the discussion of Central European Catholic lawyers on questions of toleration and permissions in law. I argue that Königsmann agreed with Grotius because his conception could be combined with the Catholic belief in free will and dictamen sanae rationis. He grounded natural law in rational human nature and rejected (...) attempts to derive natural law from the highest principle. (shrink)

This comment questions Lister's reading of the reciprocity condition in three respects. First, it challenges the view that this condition necessarily leads to egalitarian claims about just distribution. Secondly, it questions Lister's argument that the reciprocity condition is linked to substantial schemes of egalitarian distribution irrespective of context. Thirdly, it claims that entitlements to justice for people with mental or psychological impairments cannot be based on a distinction between willingness and unwillingness to contribute to the cooperative venture of a society.

Quality of life is an important outcome measure in mental health care. Currently, QoL is mainly measured with paper and pencil questionnaires. To contribute to the evaluation of treatment, and to enhance substantiated policy decisions in the allocation of resources, a web-based, personalized, patient-friendly and easy to administer QoL instrument has been developed: the QoL-ME. While human values play a significant role in shaping future use practices of technologies, it is important to anticipate on them during the design of the (...) QoL-instrument. The value sensitive design approach offers a theory and method for addressing these values in a systematic and principled manner in the design of technologies. While the VSD approach has been applied in the field of somatic care, we extended the VSD approach to the field of mental healthcare with the aim to enable developers of the QoL-instrument to reflect on important human values and anticipate potential value conflicts in its design. We therefore explored how VSD can be used by investigating the human values that are relevant for the design of the QoL-ME. Our exploration reveals that the values autonomy, efficiency, empowerment, universal usability, privacy, redifinition of roles, of responsibilites, reliability, solidarity, surveillance and trust are at stake for the future users of the technology. However, we argue that theoretical reflections on the potential ethical impact of a technology in the design phase can only go so far. To be able to comprehensively evaluate the usability the VSD approach, a supplementary study of the use practices of the technology is needed. (shrink)

The designation of Diego Maradona’s ‘handball’ goal, that it was an intervention by God himself, brings the phenomena of sport and religion into an interrelationship. The basic thesis of this paper is that, despite many of their phenomenal similarities, explicit religion is not, and cannot be, substantially related to sport, as the two manifest themselves in different ways of being. This thesis is supported by arguments from three philosophical areas: 1. The ontological dimension of the manifestation of the sacred in (...) the profane through the process of hierophany in sport does not refer to a specific deity or God, and is therefore not a presentation but an indirect representation of the sacred; 2. The epistemological perspective of the intentional relation of consciousness to religious ritual justifies the necessity of situating them in an overall horizon of references and meanings to the horizon of the lifeworld; 3. The existential and experiential aspects of transformative sport experiences transform the horizon of meanings of empirical reality, but lack the sacramental perspective. Implicit religion as a possibility of transition on a continuum of complementary existential states is a suitable explicative framework for analyzing the phenomenal similarities and essential differences of religion and sport. Before examining de Moivre's contributions to the science of mathematics, this article reviews the source materials, consisting of the printed works and the correspondence of de Moivre, and constructs his biography from them. The analytical part examines de Moivre's contributions and achievements in the study of equations, series, and the calculus of probability. De Moivre contributed to the continuing development from Viète to Abel and Galois of the theory of solving equations by means of constructing particular equations, the roots of (...) which can be written in the form $$\sqrt[n]{{a + \sqrt b }} + \sqrt[n]{{a - \sqrt b }}$$. He also discovered the reciprocal equations. In the course of this work de Moivre discovered an expression equivalent to (cos α+i sin α) n =cos n α+i sin n α and, following Cotes, he succeeded in expressing the nth roots of unity in trigonometric form. In the theory of series, de Moivre developed a polynomial theorem encom-passing Newton's binomial theorem and, in particular, a theorem of recurrent series useful in the calculus of probability. The demands of the calculus of probability led de Moivre to an approximation for the binomial coefficients $$\left( {_m^n } \right)$$ for large values of n. The interaction between de Moivre and James Stirling, particularly in regard to the asymptotic series for log (n!), is treated at length. This work supplied the foundation for de Moivre's limit theorem for the binomial distribution. The calculus of probability, which occupied him from 1708 onward, became in time ever more the center of de Moivre's inquiries. Proceeding from contemporary collections of gambling exercises, de Moivre, by introducing an explicit measure of probability for the so-called Laplace experiments, found the beginnings of a theory of probability. De Moivre expanded the classic application of probability calculus to games of chance by addressing himself to the problem of annuities and by adopting Halley's work with its conception of “Probability of life”. De Moivre was the first to publish a mathematically formulated law for the decrements of life derived from mortality tables. (shrink)

The main objective of this paper is to sketch unifying conceptual and formal framework for inference that is able to explain various proof techniques without implicitly changing the underlying notion of inference rules. We base this framework upon the so-called two-dimensional, i.e., deduction to deduction, account of inference introduced by Tichý in his seminal work The Foundation’s of Frege’s Logic (1988). Consequently, it will be argued that sequent calculus provides suitable basis for such general concept of inference and therefore should (...) not be seen just as technical tool, but philosophically well-founded system that can rival natural deduction in terms of its “naturalness”.
